Township named as party to divorce suit
YOUNGSTOWN Boardman Trustee Robyn Gallitto is asking a judge to prohibit the township from paying her estranged husband for accrued vacation and sick time.
Gallitto filed for divorce from her husband, Nick Levinsky, last November. Levinsky resigned Feb. 9 from his job with the township police department, a day before he pleaded guilty to and was convicted of a telecommunications harassment charge.
The charge dealt with threats Levinsky was accused of making against Gallitto on a political message board.
In a motion filed Tuesday in Mahoning County Domestic Relations Court, Gallitto's attorney William R. Biviano of Warren asks the court to add the township to the divorce proceeding.
The township's inclusion is "for the purpose of being restrained in paying over" to Levinsky "any monetary value for the unused vacation time and remaining sick time" that he earned from their marriage on June 10, 2000, to Feb. 9.
The motion says that money is a marital asset.
An exhibit included with the motion lists Levinsky's total compensation at $17,385.
Upon resolution of the issue, the township will be dismissed as a party to the case.
