Man gets 6 months in prison in killing of his brother, 28



WARREN — Charles H. Smith Jr., 46, charged with voluntary manslaughter in the stabbing death of his 28-year-old brother Carl on April 14, has accepted a plea agreement for six months in jail and five years on probation.

Smith, of 1503 S. Leavitt Road, will also be ordered to undergo a treatment program at the Northeast Ohio Community Alternative Program of Warren or a similar program, according to the plea agreement. He will be sentenced later in Trumbull County Common Pleas Court by Judge Peter Kontos.

David Toepfer, an assistant county prosecutor, said the agreement was acceptable to the Smith family.

Toepfer said it is still not clear what started the fight.

Police said Charles Smith got into a fight with Carl Smith at the home at 806 Kinsman St. N.W. where Carl Smith lived with two of his brothers, Charles Smith's son and his mother.

When police arrived at the home just after midnight, they found Charles Smith in the living room in a semi-conscious state, while Carl Smith was lying on the dining room floor with several stab wounds on the chest and abdomen. A kitchen knife was found next to the dead brother.

Charles Smith had been indicted on a first-degree felony punishable by up to 10 years in prison. His plea agreement was to a third-degree felony, punishable by up to five years in prison.
